Acceptable Use Policy

1. Introduction

This Acceptable Use Policy ("AUP") sets forth the rules and guidelines for using Anton Payments services. By using our services, you agree to comply with this AUP. Violations of this AUP may result in suspension or termination of your account and access to our services.

This AUP is incorporated by reference into our Terms of Service and Master Services Agreement. Capitalized terms used but not defined in this AUP have the meanings given to them in those agreements.

2. Prohibited Activities

You may not use our services to engage in any of the following prohibited activities:

2.1 Illegal Activities

  • Money laundering, terrorist financing, or other financial crimes
  • Fraud, theft, embezzlement, or other criminal activities
  • Violation of any applicable laws, regulations, or industry standards
  • Processing payments for illegal goods or services
  • Tax evasion or other violations of tax laws
  • Violations of sanctions or embargoes

2.2 Prohibited Business Types

You may not use our services for the following types of businesses or activities:

  • Gambling and Gaming: Online gambling, sports betting, casinos, or other gaming activities where prohibited by law
  • Adult Content: Pornography, adult entertainment, or other adult content where prohibited by law
  • Weapons and Ammunition: Sale of firearms, ammunition, or other weapons
  • Controlled Substances: Sale of illegal drugs, prescription drugs without proper authorization, or other controlled substances
  • Counterfeit Goods: Sale of counterfeit, pirated, or stolen goods
  • Pyramid Schemes: Multi-level marketing or pyramid schemes
  • Debt Collection: Aggressive or illegal debt collection practices
  • Cryptocurrency Exchanges: Unregulated cryptocurrency exchanges or trading platforms (regulated exchanges may be permitted subject to review)
  • Forex Trading: Unregulated foreign exchange trading platforms
  • High-Risk Financial Services: Payday loans, title loans, or other high-risk lending activities without proper licensing

2.3 Fraud and Abuse

  • Creating fake accounts or using false identities
  • Processing fraudulent or unauthorized transactions
  • Chargeback fraud or friendly fraud
  • Using stolen payment methods or credit cards
  • Phishing, spoofing, or other social engineering attacks
  • Identity theft or impersonation
  • Circumventing security measures or fraud detection systems

2.4 Intellectual Property Violations

  • Infringing on copyrights, trademarks, patents, or other intellectual property rights
  • Distributing pirated software, music, movies, or other copyrighted content
  • Using our services to facilitate intellectual property infringement

2.5 Harmful or Offensive Content

  • Hate speech, harassment, or discrimination
  • Threats of violence or harm
  • Child exploitation or abuse
  • Defamation or libel
  • Content that promotes illegal activities

2.6 Technical Abuse

  • Attempting to gain unauthorized access to our systems, accounts, or data
  • Interfering with or disrupting our services, servers, or networks
  • Using automated systems (bots, scrapers) to access our services without authorization
  • Reverse engineering, decompiling, or disassembling our services
  • Transmitting viruses, malware, or other harmful code
  • Conducting denial-of-service (DoS) attacks or distributed denial-of-service (DDoS) attacks
  • Exploiting security vulnerabilities
  • Excessive API usage that degrades service performance

2.7 Misuse of Services

  • Using our services in a manner that violates our Terms of Service
  • Circumventing transaction limits or restrictions
  • Creating multiple accounts to evade limits or restrictions
  • Reselling or sublicensing our services without authorization
  • Using our services to compete with us or build competing products
  • Collecting or harvesting information about other users without consent

3. Compliance Requirements

You must comply with all applicable laws and regulations, including:

  • Anti-Money Laundering (AML): Comply with AML laws and regulations
  • Know Your Customer (KYC): Verify the identity of your customers and payees
  • Sanctions: Comply with OFAC sanctions and other sanctions programs
  • Data Protection: Comply with GDPR, CCPA, and other data protection laws
  • Payment Card Industry (PCI): Comply with PCI DSS requirements if handling card data
  • Tax Laws: Comply with tax reporting and withholding requirements
  • Licensing: Obtain and maintain all necessary licenses and permits

4. Restricted Activities

The following activities are restricted and may require prior approval or additional documentation:

  • High-volume or high-value transactions
  • Transactions involving high-risk countries or regions
  • Certain types of recurring payments or subscriptions
  • Transactions involving cryptocurrencies or digital assets
  • Transactions for regulated industries (healthcare, financial services, etc.)
  • Cross-border transactions to certain jurisdictions

If you plan to engage in any restricted activities, please contact us in advance to discuss requirements and obtain necessary approvals.

5. Monitoring and Enforcement

We actively monitor our services for violations of this AUP. We may:

  • Review transactions, accounts, and activities for compliance
  • Use automated systems to detect suspicious or prohibited activities
  • Request additional information or documentation from you
  • Conduct compliance audits
  • Report violations to law enforcement or regulatory authorities

6. Consequences of Violations

Violations of this AUP may result in:

  • Warning: Written warning for minor or first-time violations
  • Suspension: Temporary suspension of your account or specific services
  • Termination: Permanent termination of your account and access to our services
  • Legal Action: Referral to law enforcement or regulatory authorities
  • Financial Penalties: Assessment of fees or penalties for violations
  • Reserve Requirements: Requirement to maintain additional reserves

We reserve the right to take any action we deem necessary to protect our services, users, and comply with legal obligations. We may take action immediately and without prior notice in cases of serious violations or threats to security.

7. Reporting Violations

If you become aware of any violation of this AUP, please report it to us immediately at [email protected]. We will investigate all reports and take appropriate action.

8. Changes to This Policy

We may update this AUP from time to time. Material changes will be communicated to you by email or through our platform. Your continued use of our services after such changes constitutes acceptance of the updated AUP.
